1. Agreement to Terms
By accessing, browsing, or purchasing from Forto Labs (“Forto Labs,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use our website or purchase our products.
2. Research Use Only
All products sold through Forto Labs are intended strictly for in-vitro research and laboratory use only. Products are NOT for human consumption, veterinary or animal use, or any therapeutic, diagnostic, clinical, cosmetic, food, or household application. By purchasing, you confirm you are acquiring products exclusively for lawful laboratory research and development.
3. Eligibility & Research-Use Attestation
By placing an order, you represent and warrant that: (a) you are at least 21 years of age; (b) you are a qualified researcher, or are purchasing on behalf of a research institution, laboratory, university, or other research-based facility that warrants the purchase and use of these products for in-vitro research purposes only; and (c) all products will be used solely for lawful laboratory research and development. You acknowledge that any purchase made without such qualification or affiliation is a misrepresentation for which you may be held liable. Forto Labs products are not drugs, foods, dietary supplements, cosmetics, or medical devices.
4. Prohibited Uses
Products may not be consumed by, administered to, or applied to any human or animal, and may not be combined, mixed, adulterated, repackaged, relabeled, or resold for any such purpose, or used for any therapeutic, diagnostic, clinical, cosmetic, food, or household application. You agree not to use our products or website in violation of any applicable law or regulation.
5. Right to Refuse or Cancel Sales
Forto Labs reserves the right, at its sole discretion, to refuse, limit, cancel, or delay any order and to decline sale to any person or entity, for any reason, including where we believe products may be used for unauthorized purposes. Any communication indicating intended human or animal use may result in cancellation and a permanent purchasing restriction.
6. No Warranty
ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
7. Assumption of Risk
Research chemicals and peptides may be hazardous and must be handled only by qualified personnel. You assume all risk associated with their handling, storage, and use, and are responsible for informing yourself of, and complying with, all applicable regulations and health-and-safety requirements.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTO LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OR MISUSE OF OUR PRODUCTS OR SERVICES, AND OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Forto Labs, its officers, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of any product, or your violation of any law or the rights of any third party.
10. FDA / Regulatory Disclaimer
These statements and products have not been evaluated by the U.S. Food and Drug Administration. Products are not drugs, dietary supplements, or foods within the meaning of the Federal Food, Drug, and Cosmetic Act or the Dietary Supplement Health and Education Act, and are not intended to diagnose, treat, cure, or prevent any disease. Products are sold strictly for in-vitro laboratory research use only.
11. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas for the resolution of any dispute arising out of or relating to these Terms or your use of our products.
13. Compliance With Applicable Laws
You are solely responsible for knowing and complying with all laws, regulations, and restrictions applicable in your jurisdiction regarding the purchase, import, possession, handling, and use of research compounds. You represent that your purchase and use of our products does not violate any applicable law, and you agree not to export, re-export, or transfer any product in violation of U.S. export-control or other applicable laws.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the website or purchase of products after changes are posted constitutes acceptance of the revised Terms.
